Terms and Conditions
Introduction
1.1 These terms and conditions ("Terms") govern your use of the Gamma platform ("Platform") provided by MYGDA OÜ ("Company"). By accessing or using the Platform, you agree to be bound by these Terms.
1.2 The Platform allows you to generate QR codes for obtaining discounts at partner establishments such as restaurants, bars, cafes, and e-commerce platforms. These partners are independent entities and the Company does not guarantee the availability, quality, or any issues related to the services or products provided by the partners.
Account Registration
2.1 To access certain features of the Platform, you may be required to create an account. You must provide accurate and complete information during the registration process and keep your account credentials confidential. You are responsible for all activities that occur under your account.
2.2 The Company reserves the right to suspend or terminate your account at its discretion if you violate these Terms or engage in any fraudulent, abusive, or illegal activities.
Use of the Platform
3.1 The Platform is provided on an "as is" basis and the Company makes no warranties or representations regarding its functionality, availability, or suitability for your specific needs. The Company reserves the right to modify, suspend, or discontinue the Platform at any time without prior notice.
3.2 The QR codes generated through the Platform are for personal use only and should not be used for any illegal or unauthorized purposes. You agree not to distribute, sell, or misuse the QR codes in any way that violates applicable laws or the rights of others.
Intellectual Property
4.1 All intellectual property rights in the Platform, including but not limited to trademarks, logos, software, and content, are owned by the Company or its licensors. You are granted a limited, non-exclusive, and non-transferable license to use the Platform solely for your personal and non-commercial purposes.
Privacy
5.1 Your privacy is important to us. The Company collects, stores, and processes your personal information in accordance with its Privacy Policy. By using the Platform, you consent to the Company's collection and use of your personal information as described in the Privacy Policy.
Limitation of Liability
6.1 The Company shall not be liable for any damages, losses, or claims arising out of or in connection with your use of the Platform or any services provided by the partners. You acknowledge that the Company is not responsible for the actions or omissions of the partners, and any disputes or issues related to the services or products provided by the partners should be resolved directly with them.
6.2 To the maximum extent permitted by law, the Company disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Termination
7.1 The Company reserves the right to terminate or suspend your access to the Platform at any time without prior notice, for any reason, including but not limited to violations of these Terms.
Governing Law and Jurisdiction
8.1 These Terms shall be governed by and construed in accordance with the laws of Estonia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia.
